1. About us

Below referred to as "369 Lab", "the studio" or "the Controller".

2. Acceptance of terms

Browsing and using the 369lab.it website, as well as submitting requests through the contact form or purchasing products, implies full acceptance of these Terms and Conditions. Anyone who does not accept even part of these terms is asked not to use the site.

3. Scope of the website

369lab.it is the website of a creative studio that:

• presents its services in branding, signage, window graphics, ambient design, art printing and digital solutions;
• allows visitors to request information or quotes through the contact form;
• offers a catalog of art canvas prints and related products through the /products section;
• hosts an editorial blog with articles on branding, visual design and digital.

4. Intellectual property

All content on the site — texts, images, videos, graphics, logos, code, portfolio works, blog articles, product pages, art prints — is owned by 369 Lab or by the respective rights holders and is protected by Italian and international laws on copyright and industrial property.

Reproduction, distribution, modification, re-publication or use in any form, whether in whole or in part, of the content of the site without prior written authorization from the Controller is prohibited. Standard quotations for criticism, review or information purposes are allowed within the limits set by law.

The "369 Lab" name, logo and graphic symbol are marks of the studio and cannot be used without authorization.

5. Contact requests

Sending a message through the contact form does not constitute a contract, a commitment or a binding quote by the studio. 369 Lab reserves the right to freely evaluate each request and not to follow up on requests that it considers incompatible with its professional line.

Use of the form for purposes other than a genuine request for information is prohibited, particularly for sending unsolicited commercial content (spam), offensive, unlawful or harassing messages.

6. Product sales — commercial conditions

6.1 Prices and availability

Product prices published on the site are in Euro, VAT included. Shipping costs, when applicable, are clearly shown on the checkout page before the order is finalized. The studio reserves the right to change prices at any time; the price applied is the one shown at the time of the order.

Product availability shown on the site is updated to the best of our ability but is not binding; should a product become unavailable after an order, the customer will be contacted to agree on a solution (replacement, waiting time or full refund).

6.2 Contract formation

The sale contract is concluded when the customer receives the order confirmation email from 369 Lab, sent after payment is completed. The studio may refuse an order within a reasonable time in justified cases (e.g. product no longer available, suspected fraud, clearly erroneous order), fully refunding anything the customer may have paid.

6.3 Payment

Payment can be made with the methods shown at checkout: credit/debit card (circuit handled by Stripe), bank transfer, or cash on delivery (where available, Italy only). Card details are entered directly on the Stripe platform and are never visible to or stored by 369 Lab.

6.4 Shipping and delivery

Products are shipped to the address indicated by the customer at checkout via national or international couriers. Indicative preparation and shipping times are shown in the product page or in the order confirmation. Any delays due to causes outside the studio's control (couriers, customs, force majeure) do not entail liability for 369 Lab.

6.5 Right of withdrawal (for consumers)

Under Italian Legislative Decree 206/2005 (Consumer Code), the consumer customer has the right to withdraw from the purchase within 14 days from receipt of the goods, without having to give any reason. To exercise the withdrawal, simply send a communication to info@369lab.it specifying the order number. The product must be returned, at the customer's care and expense, intact and in the original packaging. The refund will be issued within 14 days of receipt of the return.

Exclusions: the right of withdrawal does not apply to products made to measure or clearly personalized for the customer (Art. 59 D.Lgs. 206/2005), including for example personalized prints, canvases with images generated on request through the Art Print / AI Canvas service, signs or graphics produced on commission.

6.6 Legal warranty of conformity

All products sold to consumers benefit from the 24-month legal warranty of conformity provided by Art. 128 et seq. of the Italian Consumer Code. In case of defect the customer may request repair or replacement of the item, or alternatively a price reduction or termination of the contract, as provided by law.

7. Proper use of the site

The user undertakes to use the site in compliance with the law, morality and good manners. In particular it is forbidden to:

• access restricted areas without authorization (e.g. admin dashboard);
• attempt to compromise the security of the site, servers or connected services;
• use bots, scrapers or automated tools to collect content or data in bulk without authorization;
• send viruses, malware or malicious code;
• use content of the site in breach of copyright;
• use the contact form to send spam or unlawful content.

The Controller reserves the right to block access to users who violate these conditions and to take appropriate legal action.

8. Links to third-party sites

The site may contain links to third-party websites (e.g. social profiles, Stripe, partner sites). The Controller does not control and is not responsible for the content, services or privacy policies of such external sites. Use of such links is at the user's own risk.

9. Limitation of liability

369 Lab is committed to keeping the site up to date and operational but does not guarantee continuous availability or absence of errors or interruptions due to maintenance, technical issues of the hosting provider or force majeure. To the extent permitted by law, the Controller is not liable for any damages, direct or indirect, arising from the use or impossibility to use the site or its content. Nothing in these Terms limits or excludes the Controller's liability for willful misconduct, gross negligence or in cases where such limitation is prohibited by law.

10. Personal data processing

Personal data collected through the site are processed as described in detail in the Privacy Policy, which forms an integral part of these Terms.

11. Changes to the Terms

The Controller reserves the right to change these Terms at any time, publishing the updated version on this page with the new last-updated date. Use of the site after the publication of changes constitutes acceptance of them. For purchases already concluded the terms in force at the time of the order remain applicable.

12. Governing law and competent court

These Terms are governed by Italian law. For any dispute arising from use of the site or purchase of products, the court of the consumer's place of residence or domicile shall have jurisdiction, where the user is a consumer. For relationships with non-consumer customers the Court of Milan shall have exclusive jurisdiction.

13. ODR — Online dispute resolution

Pursuant to Art. 14 of EU Regulation 524/2013, consumer customers are informed that, in case of a dispute arising from the purchase, they may use the European online dispute resolution platform available at https://ec.europa.eu/consumers/odr.
